Even if the case reaches a jury, prosecutors still must prove the required threatening intent/state of mind beyond a reasonable doubt. And even a conviction doesn't automatically mean incarceration; sentencing would come afterward.
So, yes, I think trial is more likely than not. But from where things stand today, I would not bet that Comey ever actually spends time behind bars.
