New Letitia James development — former NY prosecutor says he is retaining internal records

There is one genuinely new quasi-legal development involving Letitia James.

On October 5, former New York Assistant Attorney General Daniel Wiesenfeld sent James and her general counsel an email stating that he will not return internal materials that the Attorney General's office says are confidential and privileged. Wiesenfeld says the records support his earlier allegation that personnel in James's office improperly targeted President Trump and Trump-affiliated entities.

This moves the matter beyond Wiesenfeld's August accusation. According to the new report, James's office has been seeking return of the materials, while Wiesenfeld is deliberately retaining them and asserting that they constitute evidence of political corruption. He also disclosed that a detective assigned to the Attorney General's Executive Protection Detail recently went to his residence and left a business card at his door.

The underlying allegation remains unproven. Wiesenfeld previously alleged that his supervisor instructed him to "find and pursue crimes" involving Trump, Truth Social and other targets without what he regarded as a credible predicate. James's office has rejected the allegation and characterized the dispute as a personnel matter.

What makes today's development worth watching is the documents. If Wiesenfeld actually possesses contemporaneous emails, directives or investigative records supporting his account, those could potentially become evidence in the existing federal scrutiny, congressional proceedings, litigation or a whistleblower disclosure. At present, however, we do not know what the retained documents contain, and there has been no judicial or investigative finding validating his claims.
